A New York appeals court has thrown open the floodgates for racial gerrymandering, overturning a lower court’s ruling that struck down the state’s race-based Voting Rights Act of 2022. The decision gives the radical left exactly what it wants: a legal weapon to force racial redistricting and tip elections in their favor.
The law, which allows voters to challenge at-large elections on racial or ethnic grounds, was previously struck down in 2024 by Orange County state court Justice Maria Vazquez-Doles, who ruled it violated the Equal Protection Clause of the 14th Amendment. Her reasoning? The Constitution protects all Americans from discrimination, not just specific racial groups. The judge even referenced the U.S. Supreme Court’s ruling that struck down affirmative action in college admissions, pointing out that the same principles apply to voting rights.
But in a move that should send chills down the spine of every freedom-loving American, the Appellate Division of the New York Supreme Court reversed the decision, siding with Attorney General Letitia James and radical activists who argue that “equity” trumps equal rights.
The case stemmed from a lawsuit brought by the town of Newburgh, where leftist activists claimed that the majority-white town’s at-large election system “diluted” the votes of black and Hispanic residents. Instead of simply electing the best candidates, regardless of race, they demanded a district-based election system that would guarantee the racial outcomes they desire.
Justice Hector LaSalle, writing for the appellate panel, ruled that Newburgh “failed to show as a matter of law” that the law forced them to violate the Constitution. In other words, the court ignored the blatant fact that the New York Voting Rights Act prioritizes race over equal treatment under the law—an outright violation of everything the 14th Amendment stands for.
Letitia James wasted no time celebrating the ruling, declaring,
“Our democracy thrives when all voters, regardless of their background, can make their voices heard at the ballot box.”
Translation: Democracy thrives when left-wing activists get to redraw maps until they win.
This ruling sets a dangerous precedent. If Democrats can gerrymander districts based on race in New York, what’s stopping them from doing it everywhere? This isn’t about fairness—it’s about engineering election results to maintain power.
Once again, the radical left proves they don’t care about equal protection under the law. They only care about one thing: rigging the system to ensure permanent Democratic control.
